Khaberni - The Economic Court of Appeal in Cairo ruled to dismiss the compensation lawsuit of five million Egyptian pounds, which was filed by actress Afaf Shuaib against director Mohamed Samy, accusing him of defamation.
The reasons for the judgment stated that the court, upon reviewing the lawsuit documents, found the decision under appeal to be correct and in accordance with reality and law, presented on acceptable and sufficient grounds to sustain it, leading to the conclusion reached in its decree.
The reasons continued, stating that the appellant did not present new defenses essentially different from what was presented to the first instance court, which the appealed judgment addressed, thus, this court adheres to the appealed judgment in what it concluded in its decree based on its reasons and decides to reject the appeal and uphold the appealed judgment.
In the decree, it stated: "Firstly, accepting the appeal in form... Secondly, regarding the subject of the appeal by rejecting it and upholding the appealed judgment, and obliging the appellant to pay the costs of her appeal and a sum of 100 Egyptian pounds in attorney's fees".
Mohamed Samy mocks Afaf Shuaib's persistence in suing him
Mohamed Samy commented on the court's decision to dismiss the compensation lawsuit brought by Afaf Shuaib against him for defamation, stating in a post on his personal "Facebook" account: "Madam Afaf Shuaib has been raising cases against me for two years and losing them, and today was the last case and she lost again, I don’t know why she is insistent on suing me groundlessly and claims that I insulted and mistreated her on a television program, which did not happen, and the courts ruled that it did not happen with final judgments, and the courts based their judgments on the fact that there was no transgression or offense from me towards her, and all the judgments issued by the criminal and civil courts were in my favor at all levels".
He added: "Actually, the episode she claimed I insulted her in is available online and anyone can see it, I would never transgress the respect due to a woman of my mother's age or older, moreover a great artist with her stature."
Mohamed Samy concluded his post by saying: "This is the first time I comment on this matter because I waited until the artist lost the cases at all levels as it happened and then I speak, and now I am discussing with my legal advisor Mr. Shaaban Said the lawyer what we are supposed to do during this period after two years of transgression against my rights and personal defamation, whether we start taking legal actions against her for compensation for defamation and spoiling of reputation or we say may Allah forgive what is past and now her lawyer have enough to deal with, maybe we just ignore it and don’t deepen their distress, forgive them, and invite them for dinner outside, treat them to ribs and pizza".
