The Legality of Notables Approves Amendments to the Notary and Endowments Laws

Khaberni - The legal committee in the Council of Notables, approved the draft amended Notary Law for the year 2025, and the draft amended law for the Endowments, Affairs, and Islamic Sanctities for the year 2025, as received from the House of Representatives.

This occurred during a meeting held by the committee on Tuesday, chaired by Ain Ahmad Tabaishat, and attended by the Minister of Justice Basam Talhouni, the Minister of Endowments, Affairs and Islamic Sanctities Muhammad Al-Khalayleh, the Minister of Digital Economy and Entrepreneurship Sami Samirat, and the Secretary-General of the Ministry of Justice Walid Knakriah.

The reasons for the amended Notary Law are to improve the quality of public services provided to citizens, by allowing the notary to process transactions submitted from outside the kingdom electronically, while permitting the use of electronic means in notary transactions, giving them the legal status prescribed for paper transactions.

According to the amendments, the territorial jurisdiction of the notary will be expanded to include all provinces without adhering to the territorial jurisdiction rules of the court to which it belongs, in order to reduce the time, effort, and cost on citizens and service recipients and enable them to complete their transactions electronically or at the nearest available location.

According to the reasons for the amended law for Endowments, Affairs and Islamic Sanctities; it came to reorganize the Council of Endowments, Affairs, and Islamic Sanctities in a way that ensures the investment of movable and immovable endowment funds and purchasing properties, safeguarding the interest of the endowment in accordance with the provisions of Islamic Shari'ah and the conditions of the endowers, and replacing bonds with sukuk (Islamic bonds).

It also came to control the properties and funds of the Hajj Fund and consider it a proper endowment, excluding the funds of savers, and to add programs of the Holy Quran to the endowment programs, and to cancel the Fatwa Affairs from the tasks of the Ministry of Endowments and Islamic Sanctities as it has become under the jurisdiction of the General Fatwa Department according to the General Fatwa Law.
