Federal Court Trump Administration Cannot End Birthright Citizenship

Khaberni - The U.S. Federal Appeals Court in Boston ruled that President Donald Trump's administration may not deny citizenship to children born to people residing in the country illegally or temporarily.

A panel of three judges from the First U.S. Circuit Court of Appeals on Friday became the fifth federal court since June to issue or uphold orders preventing the execution of the President's order, which targeted ending the automatic granting of citizenship to these children after their birth.

The court concluded that it is likely that the plaintiffs will succeed in their claim that the children mentioned in the order are eligible for citizenship at birth under the citizenship clause of the Fourteenth Amendment to the U.S. Constitution.

The case is expected to be quickly referred to the Supreme Court, which has limited the power of lower court judges to issue nationwide judicial orders in a ruling issued last June.

A second appeals court also ruled on Friday in favor of several organizations that challenged Trump's order to end citizenship by birth.
