UAE Fake Broker Embezzles Money from a Girl in an Apartment Rental Ad

Khaberni - The Abu Dhabi Court for Family, Civil and Administrative Matters has ordered a fraudster to pay a girl an amount of 5110 dirhams and additionally 1500 dirhams in compensation for defrauding her and embezzling her money through a fraudulent ad for an apartment rental.

In detail, a girl filed a lawsuit against a fake broker, demanding him to pay her an amount of 5110 dirhams and compensate her with an amount of 5000 dirhams for both material and moral damages, including legal fees and expenses. She pointed to his fraud through offering an apartment for rent and deceptively taking the claim amount from her. He was criminally convicted and the court fined him 15,000 dirhams.

The court explained in its ruling that according to the established procedures of criminal law, the final judgment issued in criminal matters shall have its effect in the civil lawsuit, whenever it definitively resolved the occurrence of the act and its attribution to the perpetrator. Once the criminal court has ruled on these matters, civil courts are not allowed to reconsider them, and are bound to take them into account in considering the connected civil rights, noting that the criminal judgment, which is the basis of the lawsuit, had determined the fault on the part of the defendant, and proved that he fraudulently withdrew the claim amount for his benefit from the plaintiff’s bank card.

Regarding the claim for damages, the court pointed out that the plaintiff suffered material damage due to the defendant holding the amount without benefit, and also suffered psychological and moral harm due to the unlawful act of the defendant, and deserved compensation not aimed at enrichment, but to repair the damage suffered by the affected person. The court ordered the defendant to pay the plaintiff an amount of 5110 dirhams, monetary and moral compensation amounting to 1500 dirhams, and ordered him to bear the lawsuit expenses and fees.
