Appeal Overturns Ruling to Imprison Father Who Assaulted His Son at a School in Jordan

Khaberni - The Amman Misdemeanor Court issued an in absentia ruling to imprison a Jordanian citizen for two months and fined him financially after convicting him of abuse according to Article 334 of the Penal Code, following his assault by beating his minor son inside a school while attending to receive his grades, where injuries were documented by preliminary and definitive medical reports.

The court's decision stated that the material and moral elements of the crime were met in the case, prompting it to issue the ruling after hearing the testimonies of both parties and reviewing the evidence and medical reports.

In response, the defense attorney filed an appeal with the Amman Court of First Instance in its appellate capacity, explaining that the incident was a result of the father's reaction to his son's behaviors, which included insults and contempt, and that the intent was discipline, not harm. He emphasized that the complaint was filed by the minor's mother, who lacks the legal standing to litigate on behalf of her son.

The appellate court accepted the appeal and decided to annul the judgment and stop the legal prosecution, based on the complainant not having the legal authority according to Article 3/b of the Criminal Procedure Law, indicating that the decision does not waive the personal rights of the parties, and reflects the judiciary's commitment to ensuring justice and the integrity of procedures.
