Khaberni - Written by the legal insurance and social protection expert, Musa Al-Subaihi:
The Social Security Law includes a special table for disability percentages resulting from work injuries (Table No. "2" list of work injuries), which mentions the causes of disability resulting from work injuries that insured individuals may experience, and the disability percentage for each case. For each permanent disability arising from a work injury, there is a specific percentage according to the table, and this table is obligatory for the medical committee specialized in work injuries at the Social Security institution. It is noted that the table provides the committee with the authority to estimate the disability percentage between a minimum and a maximum in some cases, not all, depending on the case presented to it.
Just as article (34/A) of the Social Security Law obliges the Social Security institution and its medical committees to adopt the disability percentages mentioned in the table, which includes up to (370) cases, each with a defined disability percentage. However, the same article gives the medical reference at Social Security (the specialized medical committee) the authority to determine the cause of disability and its percentage in cases not listed in the table.
Examples of permanent disability cases resulting from work injuries and the defined disability percentages in the table include:
1) Loss of the index finger: If the index finger of the right hand is lost, the disability percentage is 18%. For the loss of the index finger of the left hand, the disability is 15%.
2) Partial paralysis of the right arm: The disability percentage ranges from 20% to 40%. Determining the percentage within this range is up to the medical committee according to the case presented to them.
3) Deforming osteoarthritis: The disability percentage ranges from 30% to 40%.
4) Paralysis of both lower limbs/resulting from spinal injuries: The disability percentage is 100%.
Individuals with work injuries can refer to this table to follow up on their injuries and the resulting permanent disability, and what the specialized medical committee at the Social Security institution decides for them.
