Energy Regulation Linking Property Transfer with Electricity Consumption Clearance Protects Rights

Khaberni - The Energy and Minerals Regulatory Commission confirmed that the legislative ruling included in Article 21/D of the General Electricity Law for the year 2025, which required linking real estate ownership transfer procedures with a clearance of electricity consumption debts, represents a qualitative legislative reform aimed at protecting rights, establishing justice, and enhancing transparency in real estate transactions.

The Commission stated in a press release to the Jordan News Agency (Petra) that this linkage provides a clear legal framework that prevents the transfer of any undisclosed previous financial obligations to the new owner, and eases the process for the seller to settle their commitments in a documented and legal manner, thereby enhancing the rules of fair dealing in both real estate and service transactions alike.

The Commission pointed out that the implementation of the law article concerning financial clearance, which will start to be enforced beginning of next October, falls within an integrated strategy to simplify procedures and facilitate services for subscribers.

In this context, the Commission has launched, in coordination with distribution companies, an integrated electronic service that allows obtaining the financial clearance through the websites of electricity companies, with quick and simplified steps.

It highlighted that this service aims to facilitate the completion of property transfer transactions safely and clearly, reducing the need for paper procedures or repeated commuting, while maintaining workflow according to the existing legal framework.

The Commission revealed the provision of an optional additional choice for those wishing to obtain a comprehensive financial clearance, which includes a field inspection to verify the condition of the meter and technical equipment before completing property transfer procedures.

It explained that this procedure is completely optional and non-binding, and it invites citizens to request this inspection at least three business days before completing the transaction, to ensure its completion without disrupting the transaction's course, allowing subscribers to be assured of the technical aspects without any obligation or complication.

The Commission affirmed that this system is managed within a clear legal and regulatory framework that ensures fairness and protects the rights of all parties, embodying the Commission's commitment to improving the experience of stakeholders, and raising the level of transparency and efficiency in property transfer and utility procedures.

It said that it will continue to monitor the application of Article 21/D, and develop service mechanisms based on best international practices, inviting partners, experts, and subscribers to contribute to any proposed improvements, ensuring the protection of rights, enhancing trust and balance in implementation, and enshrining Jordan's status as a model in legislative and regulatory reform.
