UAE Filming a girl without her consent costs a young man 30000 dirhams

Khaberni - The Abu Dhabi Court for Family, Civil and Administrative Disputes ordered a young man to pay a girl 20,000 dirhams in compensation for filming her without her consent.

The criminal court convicted him and fined him 10,000 dirhams, bringing the total penalty to 30,000 dirhams.

The girl filed her lawsuit as a result of being harmed by being filmed without her consent, pointing to the defendant's criminal conviction, and his fine of 10,000 dirhams.

The court explained in its judgment, that the decision issued in the criminal cases has conclusive power in the civil lawsuit before the civil courts whenever it has decisively settled the occurrence of the act forming the common foundation between the two lawsuits, criminal and civil, and in the legal description of this act and its attribution to the perpetrator, pointing out that the plaintiff had previously lodged a complaint against the defendant for invasion of privacy, which was referred to criminal trial under the charge of attack on others' privacy, resulting in a criminal judgment of conviction and a fine of 10,000 dirhams, thereby proving to the court the defendant's fault based on a final and conclusive judgment, upon which the court bases its decision.

Regarding the compensation for moral and psychological damages, it mentioned that, according to the established civil transactions law, every harm to another obliges the perpetrator to guarantee compensation, and that moral damage is anything that affects dignity and feelings or honor, including psychological pain, pointing out that the plaintiff's reputation was affected in social circles due to defamation and being filmed without her knowledge, which affects her psyche and touches her dignity and humanity, and as established by the criminal judgments convicting the defendant, the court sees the plaintiff's right to compensation for the moral and psychological damages and the resulting impact on her feelings due to the defendant's fault.

The court ruled to compel him to pay the plaintiff an amount of 20,000 dirhams, expenses, and fees.
