Khaberni - ‎The existential purpose of the Constitutional courts:
‎The formation of Constitutional courts in modern political systems was not just an addition to introduce a formal change within judicial systems, but was a response to a necessary imperative imposed by the evolving democratic process. The existential purpose of creating judicial oversight over the constitutionality of laws is to protect the social contract and fortify the foundations of the civil state based on the rule of law, pluralism, and a flexible balance of powers.
‎In this context, the role of the Constitutional judiciary does not limit itself to being a “passive guardian” of textual boundaries, but extends to making it a tool for enhancing democratic governance and ensuring that the legislative majority or executive instruments do not infringe upon human rights and civil gains of society. Constitutional justice is the safety valve that transforms the general Constitutional promises in texts of the Constitution into a living and experienced reality.

‎Key features of modern trends in Constitutional text interpretation:

‎Constitutional jurisprudence in countries with long-standing democratic traditions (such as Germany, France, and the United States) has undergone radical transformations in interpretation methods, moving beyond the traditional schools that confined the text to the historical intent of the legislator at the time of writing. Among the prominent features of these modern trends:
‎1. The "living Constitution" approach and temporal relevance
‎This trend starts from the hypothesis that the Constitution is a document written to live and address successive generations, thus its provisions should be interpreted with flexibility to accommodate economic, political, and social changes. Modern interpretation goes beyond the literal meanings of words and searches for the "constitutional spirit" behind the text, ensuring the document remains capable of leading society towards development, not hindering its progress.

‎2. Emphasizing "fundamental freedoms" over "regulatory powers"
‎In the civil state, public freedoms such as the right to organize, free expression, and political participation, are considered super-constitutional pillars. Thus, modern judicial trends, when facing a clear conflict between a text granting executive powers and another securing a civil right for citizens, often interpret the powers of the authority in the narrowest scope possible and broaden the interpretation of freedom texts; since the goal of the civil state is to empower, not to confine society within rigid procedural frameworks.

Added to these approaches, technical tools enter the core of interpretation style, and enhance its quality:

    * It interprets texts within the general structure of the Constitution and the unity of its provisions.
    * It strives to achieve coherence among the various Constitutional principles, such as the separation of powers and the rule of law.
2. Comparative interpretation
    * It depends on benefiting from the jurisprudences of Constitutional courts in other countries when facing new constitutional issues.
    * It contributes to the development of Constitutional jurisprudence while considering the uniqueness of the national Constitution system

‎3/ Purposive Interpretation
    (Purposive Interpretation)
* It focuses on the purpose or the goal that the Constitutional text aims to achieve, not just its words.
* It is used to achieve Constitutional justice and protect the fundamental principles of the state

‎4/ Interpretation consistent with international charters and human rights agreements
* It seeks to interpret Constitutional texts in a way that does not conflict with international obligations of the state, unless there is an explicit constitutional provision preventing this.
* Its presence is increasingly felt with the expansion of international human rights law rules.

‎Finally, the progressive procedure for evaluation
‎is placing any emerging or contemporary judicial constitutional experience on the "scale" of these modern trends, providing a precise scientific standard for measuring the extent to which Constitutional rulings contribute to strengthening the pillars of the civil state.
‎When courts adopt a "progressive, vital, and proportionate" approach, they transform into a driving force for political development and a protector of legal security for citizens. Meanwhile, retreating to "literal, textual" tendencies and emphasizing procedural formalities isolates the Constitutional judiciary from its vital surroundings, turning it from a means of developing political life into a tool that perpetuates bureaucratic structures at the expense of the essence of civil life.
