Escalation of Murder Crimes and Retaliation in Islamic Law

Recently, our societies have witnessed a noticeable increase in murder crimes, which imposes serious questioning about the reasons for this phenomenon and ways to handle it. Among those who attribute it to psychological disorders, pressing social circumstances, or the spread of drugs and intoxicants, a broad trend emerges that sees the crux of the problem as the lack of deterrence and the absence of effective enforcement of deterrent punishments, prominently the death penalty according to Islamic law.

It is undeniable that psychological and social factors play a role in shaping criminal behavior, yet these factors do not justify the crime nor prevent its occurrence. Moreover, the use of drugs and intoxicants increases the risk of aggressive behavior and causes individuals to lose control over their actions, often leading to the commission of serious crimes. Nevertheless, these factors are triggers, not decisive causes, unless met with a strong deterrent system that controls behavior and prevents deviation.

In this context, Islamic law comes with a comprehensive system that achieves justice and preserves lives, where it established the principle of retaliation as a right and just act, as Almighty says: "And there is life for you in retaliation, O men of understanding." This rule is not just a religious text, but a profound legislative philosophy based on protecting society from the recurrence of crime, as the perpetrator's prior knowledge that the punishment is inevitable and just acts as a strong deterrent that prevents the commission of murder.

Moreover, Islamic law gives the relatives of the victim the right to pardon or accept blood money, reflecting a unique balance between justice and mercy. The punishment is not vengeance, but a means to achieve societal stability and uphold human dignity.

The call to activate the death penalty according to Islamic law does not mean focusing solely on the punishment itself, but it should be complemented by addressing the real roots of crime, such as poverty, unemployment, family disintegration, alongside combating the scourge of drugs and enhancing religious and moral awareness.

In conclusion, protecting society is not achieved by justification or mitigation, but by achieving deterrent justice that preserves lives and restores the dignity of the law. Amidst various reasons, the application of retaliation according to Islamic law remains one of the most important tools that achieve general deterrence and affirm that human life is protected, and that any assault on it is met with justice that brooks no compromise.
