The Government Retirees According to Service Termination Decree After 30 Years Will Not Benefit from Stopping the Decree

State Minister for Legal Affairs Fayyad Al-Qadi, on Tuesday, stated that the termination of employees who have fulfilled the conditions for early retirement will not be "arbitrary" from the competent authority, according to Article (100) of the Public Sector Human Resources Management System.

In response to the presenter's question about the fate of employees who were retired according to the previous decree, Al-Qadi confirmed that the new decree will not apply to those who were placed in early retirement before the decree takes effect, saying, "The handling of the case occurs at the time of the decision's issuance."

Al-Qadi explained in an intervention on "Al-Mamlaka" that there are restricted and unrestricted powers for the competent authority, clarifying that there are mandatory authorities that the competent authority must follow in making decisions in the case of restricted powers, whereas in the case of unrestricted powers, matters are subject to the estimates of the competent authority depending on each case's circumstances.

Al-Qadi spoke about how an employee who is retired can challenge the decision in the Administrative Court if they believe that the decision was arbitrary, pointing out that court decisions can reinstate the employee to their job regardless of their position if they see that there was arbitrariness.

He continued that "anyone making a decision might have a decision that is flawed or might not be, but we must assume the administrative decision is valid, and whoever claims otherwise must prove it."

Regarding employees with fixed-term contracts, Al-Qadi clarified that individuals who perform their work well and fulfill their duties without any problems will have their contracts renewed.
