Central Bank Insurance Law Applies to All Contracts After Its Effectiveness

Khaberni - Rana Tahboub, the manager of insurance companies' surveillance at the Central Bank, said that the insurance contracts bill applies to all insurance contracts concluded after its date of effectiveness, regardless of the condition of the company, whether existing or under liquidation.

Tahboub added, on Thursday, that the bill organized the rights and obligations arising from the insurance contract parties, in addition to organizing the stages of the contractual process, which reduces disputes among the parties to the contract.

Tahboub explained that the disputes between the company and the insured are addressed according to the terms and conditions agreed upon between them, and in case of ongoing disputes, the judiciary is the reference, which interprets any ambiguity in favor of the insured.

Tahboub expects the law to curb the phenomenon of buying "crokes" due to an explicit provision that criminalizes their purchase, imposes penalties of up to a fine of 50,000 dinars or imprisonment for up to 3 years, or both, and doubles on a repeat.
