UAE A school fight costs a students guardian 30000 dirhams

Khaberni - Two students bullied their classmate inside a school in the UAE, assaulting him physically and taking photos, which caused him physical and psychological damage. Al Ain Court for Civil, Commercial, and Administrative Claims ordered the guardian of the second defendant, being the custodian of his minor son, to pay the assaulted student compensation of 30,000 dirhams, after the plaintiff (the student's guardian) withdrew the lawsuit against the first defendant.

In detail, a guardian of a student at a school in Al Ain filed a lawsuit against the guardians of two students, demanding that they be held responsible jointly and severally, as guardians of their minor children, to compensate for the material, psychological, and moral damage suffered by her son, pointing out that the two defendants bullied her son, assaulted him physically at school and home, and filmed the incident as they beat him, resulting in damages manifested in the victim's fear, mood swings, and inability to control his emotions. They were also convicted criminally, and she provided as evidence a copy of the judgment issued in the personal status lawsuit in Al Ain and a medical report.

During the hearing, the plaintiff requested to withdraw the lawsuit against the first defendant, limiting the case to the second defendant, which the court accepted.

The court clarified in its judgment that it was evident from the case files and documents, including a photocopy of the judgment convicting the son of the defendant in the present case and another regarding the assault charge on the personal safety of the complainant's son in a public place, and witnessed by people, that this act, which the criminal lawsuit was based on, was the same act relied upon by the plaintiff, thereby legally delineating the act and attributing it to its perpetrator.

Regarding the compensation claim, the court pointed out that the defendant's son was proven at fault, which resulted in harm to the plaintiff's son, manifested in physical injuries as per the criminal judgment, incapacitating him for not more than 20 days and causing him psychological pain. There was a proven causal relationship between the fault and the damage, legally obliging the defendant to compensate the plaintiff for that harm. The court ruled to confirm the plaintiff's withdrawal of her claim against the first defendant, imposing the costs of withdrawal on her, and ordered the second defendant to pay the plaintiff an amount of 30,000 dirhams as stated in the reasons, along with court fees.
