Fifth Court Prevents Trump from Denying Citizenship to US Born Children

Khaberni - The Federal Appeals Court in Boston ruled that President Donald Trump's administration cannot withhold citizenship from children born to individuals residing in the country illegally or temporarily.

A panel of three judges in the First American Appeals Court issued a ruling that supports previous judicial decisions preventing the implementation of Trump's order, making it the fifth federal court since June to uphold this prohibition.

The court concluded that the plaintiffs likely have an opportunity to prove that the affected children are eligible for citizenship under the citizenship clause of the 14th Amendment to the U.S. Constitution.

The case is expected to be referred to the Supreme Court soon, especially after the latter issued a ruling in June that limits the power of lower courts to issue nationwide injunctions.

In a ruling also issued last Friday, a second appeals court supported a challenge brought by several organizations against Trump's order, considering it unconstitutional in relation to the U.S. Constitution.

Another federal appeals court had issued a ruling in July that prevents the implementation of Trump's order regarding limiting citizenship by birth, considering it unconstitutional.

Trump began his first day in office on January 20, by signing the order, as part of his strict approach towards immigration.

He also demanded federal agencies reject the recognition of citizenship for children born in the United States to parents where at least one does not hold U.S. citizenship or permanent residency.
