Khaberni -The suffering of a Bahraini woman, who lived in the shadow of abandonment and oblivion since 2004, has ended. The Fourth Grand Sharia Court decreed her to be irrevocably divorced from her husband, following the proven abandonment by the husband and his refusal to support his wife and daughters for over twenty years.
The plaintiff's attorney, Sadika Al-Mawali, stated that her client initiated the lawsuit after enduring long suffering from complete desertion and lack of financial support, despite having an official marriage contract. She noted that the defendant (her husband) mistreated her, abandoned her, and avoided paying expenses since June 2004, despite a previous court ruling obliging him to do so, amidst her family’s unsuccessful attempts to mend the relationship, prompting her to file this lawsuit.
She mentioned that the court heard testimony from witnesses from the plaintiff’s family, who confirmed that the husband had left the country many years ago and never returned, and that she was forced to stay in her father’s house, with her family bearing the responsibility for her support during that time. Additionally, the plaintiff attached documents confirming the defendant’s refusal to comply with the preceding judgment issued against him by the Court of Execution.
Based on the established Sharia evidence, the court decided to irrevocably divorce the plaintiff with the first divorce due to desertion and lack of financial support, confirming that prolonged abandonment constitutes severe harm and grants the wife the right to take her case to Sharia court. The husband is not allowed to return to his wife unless under a new contract and dowry, while she cannot marry another man until the end of her legitimate waiting period.
