UAE A young man obliged to pay 55 thousand dirhams in compensation to a girl for insulting her and obstructing her way

Khaberni - The Abu Dhabi Court for Family, Civil, and Administrative Claims issued a judgment obligating a young man to pay a compensation amounting to 50 thousand dirhams to a girl, after proving his verbal assault on her and endangering her life in an incident that occurred in front of several people. The criminal court had previously convicted the defendant and punished him with community service for a month with a suspension of his driving license for a month, as well as fining him 5000 dirhams.

In detail, a girl filed a legal case against a young man demanding him to pay her an amount of 70 thousand dirhams in compensation for moral, psychological, and social damages due to insulting her, mistreating her, and endangering her life. She pointed out that the defendant, while she was driving her vehicle accompanied by her sister and her niece, blocked her vehicle and endangered her life, insulted her publicly in front of her sister, her niece, and passersby. He was found guilty by a criminal court ruling which became final and punished him with community service for a month and fined him 10,000 dirhams, with his driving license suspended for three months, in addition to fining him 5000 dirhams for the insult. In the appeal stage, the court ruled to amend the judgment to only include community service, reducing the suspension period of the driving license to one month, and upheld the judgment otherwise, making the judgment final and binding, while the defendant submitted a responsive memo and documents reviewed by the court.

The court, on its part, clarified in the reasons for its judgment that the judgment convicting the young man had become final and conclusive, thereby acquiring the authority of res judicata in what was ruled before the civil court, and thus it is not permissible thereafter to re-examine the elements of liability, establishing that the element of fault had conclusively proven against him, noting that this fault is the cause of the damages sustained by the plaintiff. The criminal case that was filed was based on the same act on which the civil suit was based, thus the court is bound by the established fault and its attribution to its perpetrator, and it is forbidden for it to contradict or revisit it, making the elements of liability from fault, damage, and causal relation established against the defendant.

Regarding the compensation request, the court pointed to the proven fault of the young man as per the criminal ruling issued against him, which included insulting the plaintiff with the outlined terms of insult and endangering her life, which has caused the plaintiff moral damages affecting her status, dignity, and feelings, because of the defendant’s fault. Therefore, the court saw the plaintiff's right to compensation and ruled obliging the young man to pay the plaintiff an amount of 50 thousand dirhams, obliging him to cover the fees, expenses of the lawsuit, and attorney fees, and dismissed other requests.
