Khaberni - A girl accused a young man of defrauding her after promising to buy two phones through her account on an installment purchase application, giving one as a gift to her, and then selling the phones after the purchase and taking the money, eventually stopping the installment payments.
The Abu Dhabi Court for Family, Civil, and Administrative Lawsuits ruled to reject the case due to the absence of any documents showing an agreement between them.
In detail, the girl filed a lawsuit against a young man in which she demanded him to pay 6,715 dirhams, and to compensate her for 1,500 dirhams for moral, psychological, and emotional damages, in addition to obliging him to pay for fees and expenses. She pointed out that he deceived her after convincing her to buy the phones under her name through an installment application, promising to gift her one and commit to paying the monthly installments.
She said that he waited until the completion of the purchasing process of the phones, which cost 11,511 dirhams, then sold them and took the money, promising to pay the monthly installments through the same application.
The plaintiff mentioned that the defendant paid only five installments, then stopped paying and noted a remaining amount owed by him. She reaffirmed that he repeatedly promised to pay, but failed to keep his promises.
She attached as evidence to her claim conversations through the messaging application «Snapchat».
The court clarified in the reasoning of its decision that it is proven that the plaintiff accuses the defendant of using her account on an installment purchase program to buy two phones and refrain from paying the installments. However, the claim was unspecific, and the court files lacked any evidence of the defendant using the application as well as any agreement between them, and there was no reliable evidence from the plaintiff. Regarding the «Snapchat» conversations, the court stated that they did not demonstrate what she claimed.
The court ruled to reject the lawsuit as it stands, and ordered the plaintiff to pay the lawsuit fees and expenses.
