The Minister of Justice establishes 3 specialized committees for objections complaints and for preparing a guiding manual for

Khaberni - The Minister of Justice, head of the Expertise Affairs Regulation Council, Bassam Talhouni, issued a decision to form 3 specialized committees concerned with examining objections and complaints, and for preparing a guiding manual for expert fees, as part of ongoing institutional efforts to develop the judicial expertise system, enhance procedural efficiency, and embed principles of transparency and justice.

Talhouni stated that the formation of these committees is part of the ministry’s vision aimed at enhancing the quality of expertise work, improving its efficiency, and expediting the procedures for settling objections and complaints, which will positively reflect on the speed of adjudicating cases and enhance the effectiveness of the judicial system.

He emphasized that this decision is part of a comprehensive reform approach adopted by the Ministry of Justice to update the organizational structure of the judicial expertise sector, considering it one of the fundamental components supporting the work of the courts, where specialized technical expertise enables judicial bodies to reach accurate and fair decisions based on solid scientific and professional bases.

He added that this step represents a significant milestone within the comprehensive modernization program of the justice sector, aimed at enhancing the confidence of litigants in the judiciary system, by ensuring integrity and impartiality in expert activities, and embedding the highest standards of professionalism and competence.

According to a statement issued by the ministry, the formation of these committees reflects the ministry’s dedication to creating clear and effective institutional mechanisms for addressing various issues related to expertise activities, including objections to decisions on not accrediting experts, complaints related to their performance, and matters related to fees, within legal and procedural frameworks that ensure transparency, justice, and swift achievement.

Under the decision, the first committee will examine objections submitted by candidates regarding decisions to reject their accreditation as experts at the Ministry of Justice, ensuring the review of these decisions based on objective criteria that guarantee justice and equal opportunities.

The second committee will study complaints related to the performance and professional conduct of experts, verify their compliance with adopted codes of conduct and professional standards, and make necessary recommendations about them, thereby enhancing the level of professional discipline and establishing the principle of accountability.

The third committee will focus on preparing a guiding manual for experts' fees related to expertise activities and reviewing them, achieving a balance between the rights of different parties, ensuring clarity of procedures and their fairness, and contributing to minimizing disputes related to the financial aspects of expertise activities.

It should be noted that the Expertise Affairs Regulation Council was formed under the Expertise System in front of Ordinary Courts No. (35) of 2018 and its amendments, where a council named (Expertise Affairs Regulation Council) is established under the chairmanship of the Minister of Justice, and the membership of the Secretary-General of the Ministry of Justice, presidents of Courts of Appeal in the kingdom, the head of the Bar Association, in addition to 5 persons of expertise and specialization appointed by the Minister of Justice for a period of 3 years.

The council is concerned with establishing general policies for organizing expertise activities and supervising them, ensuring the development of this vital sector and enhancing its efficiency in alignment with the requirements of modern justice.
