AlTalhouni Notary transactions electronically without the need to review the departments

Khaberni -    Minister of Justice, Bassam Al-Talhouni, said that the amended law for the notary public for the year 2025, was published in the Official Gazette and will come into effect thirty days from its publication date in the Official Gazette.

He pointed out that work is ongoing within the framework of the efforts of the National Council for Future Technology, in cooperation with the Ministry of Digital Economy, to automate all the electronic notary services and officially launch them in alignment with the directives of His Highness the Crown Prince to harness technology to serve citizens and facilitate governmental procedures.

Al-Talhouni clarified that the amended notary public law for 2025 allows the use of electronic means in notary transactions using digital signature and grants them the same legal status as paper transactions, reflecting a serious direction towards comprehensive digital transformation in the justice sector, within the highest standards of reliability and information security.

He indicated that the amended law enables service recipients to conduct their transactions at the notary public through the approved electronic means, using visual and audio communication technologies from anywhere, without the need to review the notary's offices, which saves time and effort and enhances the speed of transaction completion.

He explained that the amendments have eliminated the restriction by geographical jurisdiction, allowing citizens to complete their transactions at any notary in the kingdom regardless of the residence specified on their ID card, enhancing service flexibility. The amendments also expanded the powers of the notary public, authorizing them to certify written statements accompanied by an oath, which contributes to shortening the litigation period.

The minister confirmed that the amendments allow the registration and certification of judicial warnings electronically without the need for personal review while granting them the same legal validity as paper warnings, thus saving time and effort for lawyers and clients.

The amendments will also enable Jordanians living abroad to benefit from the notary services remotely, thus saving them the trouble of travel and movement while saving time and effort.

Al-Talhouni said that the amendments, in terms of electronic notary transactions procedures, will not eliminate the service in its traditional face-to-face form, but will keep the services available in both their current and electronic forms.

He added that the amendments enhance the investment environment and increase confidence in the Jordanian legal system through providing flexibility, speed, and accuracy in procedures, especially since they have authorized the notary public to certify signatures of contracts for individuals who are not gathered at one council, which supports organized agreements and contracts across borders. He emphasized that the amendments maintain all legal guarantees in electronic procedures, granting them the same legal validity as face-to-face procedures, as well as granting the digital copies of documents and bonds stored electronically the same legal status as paper copies, and authorized the use of digital signatures and granted them the validity of ordinary signatures.

Al-Talhouni said that the Ministry of Justice will prepare all the necessary regulations and instructions to begin implementing the use of electronic means in notary transactions, in addition to issuing the necessary systems and instructions for accrediting translators in notary transactions.
