Khaberni – The Islamic Action Front party responded to a statement from the Independent Election Commission, which gave it 60 days to rectify its situation and correct its violations, including the party name – according to the Commission's opinion.
The party considers in its statement that the demand to change the party's name lacks a clear legal basis, and that the party's name is legal and was officially adopted after its situations were rectified in 2023, and that its members include Muslims and Christians, and that the party reflects the inclusive national identity.
The party also considers that Article (5) of the Parties Law concerns the establishment of parties and does not apply to existing parties.
Hence the statement text follows:
*Clarification issued by the General Secretary of the Islamic Action Front, Engineer Wael Al-Saqa
The Islamic Action Front received an official notification from the Independent Election Commission that includes a demand to change the party's name, based on Article (5) of the Political Parties Law.
The party believes that this demand is not based on a sound legal basis, especially since the party's name was approved since its establishment in 1992, and the approval of its name and its constitution was renewed after rectifying the conditions under the effective law in 2023, without registering any violation related to it.
Article (5) of the Political Parties Law states the following:
a) The party is founded on the basis of citizenship and equality among Jordanians, commitment to democracy, and respect for political pluralism.
b) It is not permissible to establish a party on religious, sectarian, racial, or factional bases, nor on the basis of discrimination because of gender or origin.
In this context we affirm the following:
1. This article relates to the conditions for establishing parties, and does not apply to existing parties that were established decades ago, or those that were approved after the law was issued and held their general conferences according to their constitutions, and their names were officially recognized, and continued to operate and participate in parliamentary elections.
2. The intent of the article is to prevent parties from being established on a closed sectarian or religious basis, while the Islamic Action Front is a national, community-oriented party, whose membership is open to all Jordanians, and includes members from different constituencies, including Christian citizens, according to its constitution and practical operation.
3. The commission had previously approved for one of the parties, a year after its founding, to add the word "Islamic" to its name before the last parliamentary elections, which confirms that using this description does not constitute a legal violation in itself.
4. Article (5) relates to the conditions for the establishment of the party, while the law designated Article (7) for the conditions of the party name, which stipulates that the name must not be identical to another party’s name or have regional or familial connotations or be contrary to public order, which are conditions the party has not violated.
The party also reminds that during the works of the Royal Committee to Update the Political System that drafted the Parties Law, this issue was raised, and it was then confirmed that Article (5) is meant for new parties, not existing ones that were previously approved.
Therefore, adopting the party's name after holding its general conference and rectifying its conditions according to the law, makes any subsequent request to change it ungrounded in any clear legal text, especially since the commission's law does not grant it the authority to request a change of a party's name after its adoption unless desired by the party itself.
It is worth mentioning that the party is a member of multiple national political alliances, and its name has never been a title for division or a monopoly slogan, but rather a framework for public work in serving the nation within the provisions of the constitution and the law.
The party also renews its commitment to responsibly deal with the requirements of the law, having previously responded to all the required amendments to adapt its constitution, and will remain an integral part of its nation and nation, defending the issues of the citizens, steadfast in its national duty and its established values and legitimate goals.
