Constitutional rejects a challenge to the unconstitutionality of articles of the law of the Islamic University of Science

Khaberni -   The Constitutional Court rejected a challenge to the unconstitutionality of Articles 9/c, 11/b of the law of the International Islamic University of Science, number 16 of the year 2008 for not violating the provisions of the constitution.
The court decided today, Thursday, in its ruling to dismiss the challenge to the unconstitutionality of Articles 9/c – 11/b of the law of the International Islamic University of Science, number 16 of the year 2008, for not violating the constitutional provisions and not undermining the essence and core of the principle of equality guaranteed constitutionally.
It added that the equality expressed constitutionally is not of the mere mathematical equality, but rather the organizational relationship that links "the challenger" with the university determines their legal standing, in addition to the nature of the judiciary of the Constitutional Court which does not extend to monitoring the legislative options and alternatives that the legislator adopts according to their discretionary authority most suitable for the public benefit and within the limits of the constitutional authority, which is expressed by the judiciary's constitutional oversight over legislation as a legitimacy check rather than a suitability check.
