Minister of Energy Clarifies on Land Appropriation in the Gas Law

Khaberni - Minister of Energy Saleh Al-Kharabsheh said that the land appropriation for the licensee, mentioned in Article 9, paragraph (c) of the Gas Law for the year 2025, is intended only for shared use and not for individual usages or private projects.

Al-Kharabsheh explained on Wednesday, in response to inquiries from MPs during the legislative session held by the House of Representatives to discuss the Gas Law for 2025, that the appropriation is limited to facilities serving the public good, such as gas transmission or storage lines serving citizens or industrial cities, and it is not for private use.

On his part, the Minister of State for Political and Parliamentary Affairs, Abdul Monem Al-Oudat confirmed that the said article discusses shared use and does not address individual or private work, and it does not carry any constitutional violation.

Al-Oudat added that the appropriation is regulated by the real estate ownership law from Article 188 to Article 192, which outlines the procedures to be followed to achieve the public interest, ensuring that decisions are not legally nullified.

Article 9, paragraph (c) of the Gas Law for the year 2025 states that the licensee authorized to own, establish, and develop the facility intended for shared use has the right to own the lands and any necessary rights for its execution, and if the minister sees, based on a request submitted by the licensee, that owning these lands is necessary for the purposes of the facilities in a way that benefits the public interest, it will be appropriated in accordance with the provisions of the applicable real estate ownership law at the expense of the licensee, with a mechanism for its use by the licensee.
