Khaberni - The Director of the Department of Lands and Survey, Khaldoun Al-Khaldi, said on Thursday that the justifying reasons for the amended Real Property Ownership Act of 2026 will assist in speeding up the transactions of removing co-ownership, which enhances sales, purchasing, and building activities on lands following the removal of co-ownership, thus contributing to driving the economic wheel.
Al-Khaldi added, via the "Al-Mamlaka" TV channel, that the new law allows for electronic selling and partitioning, in addition to adopting digital signatures, noting that these services will soon be fully available to citizens after the issuance of the regulation related to electronic selling, in cooperation with the Ministry of Digital Economy, where these transactions will be executed via the "Sanad" application.
He explained that if these services are adopted through the "Sanad" application, there will no longer be a need for citizens to visit the Department of Lands and Survey, as all services will be electronic except for property transfer.
He continued, "After the issuance of the regulation, all electronic transactions will be completed in all their phases," affirming that the Department of Lands and Survey always aims to simplify the procedures of co-ownership removal for the citizens, in compliance with the Prime Minister's directives to accelerate the transactions of co-ownership removal and organize the powers of co-ownership removal committees.
"The registration director's powers have been delegated to the heads of offices in 14 registration directorates and 20 offices subordinate to the registration directors, to facilitate the processes of co-ownership removal," according to Al-Khaldi, who confirmed that representation by legal proxy between ancestors and descendants has been allowed, after the previous law required hiring a lawyer or the personal presence of the individual. The law has been amended to permit these judicial proxies between ancestors and descendants.
The cabinet approved on February 4, 2026, the justifying reasons for the amended Real Property Ownership Act for the year 2026 and referred it to the Legislation and Opinion Bureau to complete the procedures for its enactment.
The draft law addresses the issues of co-ownership removal by simplifying and accelerating its procedures, which will contribute to resolving many longstanding issues involving thousands of properties and bringing unused properties into the economic cycle.
The draft law includes provisions that permit electronic sales and the adoption of electronic signatures, alongside the digitization of all procedures and transactions, including payment, partitioning, and sales; this will ensure that all procedures are electronic, in accordance with the provisions of the notary law, and also aims to reduce the financial and procedural burdens associated with paper publication; this is intended to facilitate the process for citizens and reduce costs, time, and effort for them.
The President of the Jordanian Association of Real Estate Appraisers, Hisham Al-Natour, said that the justifying reasons for the amended Real Property Ownership Act align in their content with changes and updates in the real estate sector and are consistent with the interests of the citizens.
Al-Natour explained that the currently effective law requires the consent of all partners to conduct partitioning, whereas the justifying reasons for the amended law allow partitioning with the agreement of three-quarters of the property owners, by consensus among them and without harming the rights of other owners.
