Khaberni - The Dubai Traffic Court convicted both the driver and the pedestrian involved in a traffic accident that took place in the Al Muhaisnah Second area, after it was proven that the accident was not the result of a single party's error, but the result of combined behavior that included traffic negligence, alcohol consumption, and crossing the road from a non-legal position.
In detail, Dubai Police operations room received a report of a pedestrian being run over near one of the labor compounds, and upon immediate arrival at the location, it was revealed through examination and review of surveillance camera recordings that the accident was the result of a combined error between both parties.
The first accused was riding a motorcycle without considering road conditions or the presence of pedestrians, while the second accused was crossing outside of the designated pedestrian crossings, in an abnormal state due to alcohol consumption.
The accident resulted in serious injury to the second accused, who was then transported to the hospital, while the motorcycle rider and his passenger sustained minor injuries treated at the scene, in addition to damages to the vehicle involved in the accident.
During the hearing, the first accused appeared in court and denied the accusations against him, while the second accused failed to attend despite being legally notified, hence the court ruled the verdict in absentia against him, applying the Criminal Procedure Law.
In its rationale, the court concluded that the error was proven against both accused; the first for his negligence and inattention while driving, and the second for his alcohol consumption and violation of traffic rules in crossing the road, which together formed a single interconnected criminal activity that is indivisible.
Therefore, the court applied the text of Article 89 of the Federal Penal Code, considering the actions as a single crime, and sentenced the first accused to a fine of 1000 dirhams, while the second accused was fined 5000 dirhams.
