Trump Administration Faces Risk of Refunding 133 Billion in Tariffs

Khaberni - The administration of U.S. President Donald Trump faces the possibility of having to refund more than $133.5 billion in tariffs to importers if the U.S. Supreme Court rules the tariffs, which were imposed under the «International Emergency Economic Powers Act», as illegal, according to the U.S. Customs and Border Protection.

This amount represents the total tariffs estimated until December 14, which is the date of the latest statistical update released by the agency regarding imports, since the Republican president began imposing these tariffs in February of last year, based on the Economic Sanctions Act of 1977, which is supposed to be used exclusively in cases of national emergencies.

The court, which heard arguments in November regarding the legality of the tariffs imposed by Trump based on the International Emergency Economic Powers Act, is scheduled to issue its rulings on Friday's cases, without revealing the cases that will be included in these judgments.

It is still unclear whether the court will order a refund of the tariffs if it considers them illegal, or whether it will leave this matter to the lower courts or the federal government to handle.

Trump claimed in a post on social media on Monday that the United States has collected, or will soon collect, $600 billion in tariffs, although the net revenue from tariffs reached a record level of $195 billion in the fiscal year 2025, which ended on September 30, while monthly revenues since then have been at levels around the early thirty billion dollars, according to data from the U.S. Department of the Treasury.

The tariffs related to fentanyl were first imposed on goods coming from China on February 4, and on goods from Canada and Mexico that do not comply with the North American Trade Agreement on March 4.

The «reciprocal» tariffs imposed by Trump on goods coming from various countries ranged between 10% and 50% starting on April 5, with subsequent reductions in some cases as a result of trade negotiations.

Additional punitive tariffs of 40% were imposed on goods coming from Brazil on August 6, while goods from India faced additional punitive tariffs of 25% on August 27,

Revised tariffs on Japanese goods were activated as a result of a trade agreement on August 7.
