My Children Are My Soul Why Does the Law Want to Take Them from Me

Khaberni  - With the start of a new year, people open their hearts to hope and try to believe that better things are coming.
But in the hearts of many Jordanian mothers, the new year brings with it an old fear that lingers…
Fear of a law that could instantly decide the fate of children and break a mother's heart.
I am a Jordanian woman, and a mother before any title or description.
A mother who raised, stayed up late, sacrificed, and carried the responsibility for her children day after day.
Unfortunately, the current laws do not see the mother as a safe haven, but rather as a potential danger.
First: Custody Law
Why, if a divorced mother remarries, is custody of her children taken away from her and given to her mother?
Why does the law punish a mother if she tries to start a new life?
Especially if the children’s father is not present in their lives—no care, no attention, no commitment.
Islamic Sharia does not say this.
Madam Khadijah, may God be pleased with her, was married before her marriage to Prophet Muhammad, peace be upon him, and she had children. Islam does not state that a mother is deprived of her children if she remarries.
Why today do we abandon the spirit of Sharia and cling to a harsh societal law that does not consider the interests of the child?
Why not give the mother a chance to live with dignity, establish a family, and continue to care for her children?
Why is custody always taken from the mother as if she were a source of danger, while sometimes the reality is the complete opposite?
Second: Alimony Law
Why is alimony left to the discretion of each judge?
Why isn't there a clear standard, and a fair percentage of the father’s legally verified income?
Isn't this more just and fair?
Alimony is not a favor,
It is a child's right,
A right to education, health, safety, and a dignified life.
Third: Guardianship of Children
If the mother is trusted with raising the children, their morals, their protection, and their future,
Why shouldn't she also be trusted with their guardianship?
Why, if the father dies, do the children's funds and inheritance go to the judicial guardianship, as if the mother is a stranger?
While if the mother dies, the full guardianship transfers to the father, even if he is absent from the children's lives?
What’s more important?
The money?
Or the person who nurtures, protects, and provides care?
I appeal to Her Majesty Queen Rania,
The human being, the mother,
To reconsider these laws,
Laws that affect every Jordanian home,
And impact the future of innocent children,
And require mercy with justice, and justice with a human touch.
This is not an issue of women against men,
This is an issue of children,
And of a mother who wants to feel assured that the law supports her, not against her.
A new year…
And an old pain,
But hope still exists.
