House of Representatives Discusses Amended Electronic Transactions Law

Khaberni -  The House of Representatives discusses, in a legislative session on Monday, the draft amended law for the Electronic Transactions Law for the year 2025, after it was approved by the joint parliamentary committee (Legal, Digital Economy, and Entrepreneurship).

Deputy Aref Al-Saaydeh, who chaired the joint committee meeting, stated that the committee approved the draft law after reviewing its articles with relevant ministers to come up with a formulation that balances legislative development requirements and ensures citizens' rights, which supports the country's vision for digital transformation and the improvement of public services.

He pointed out that the draft law is in line with the state's approach to digital transformation, and within the government's vision aimed at facilitating services provided to citizens, noting that rapid advancements in information technology necessitate updating the legislative framework governing electronic transactions to ensure a safe legal environment for electronic uses in transactions and services, especially including electronic litigation and notary services.

Meanwhile, the head of the Digital Economy and Entrepreneurship Parliamentary Committee, Moayad Al-Alawnah, emphasized that the main goal is to move towards digital transformation and to prepare a safe electronic environment that facilitates citizens and speeds up procedures.

The deputies insisted on the necessity to ensure information security and protect personal data in all stages of providing the electronic service and called for the development of a comprehensive technical infrastructure in ministries and institutions to guarantee easy actual implementation of the law.

 

Justice Minister Bassam Talhouni said that the proposed amendments will reflect positively on court operations, especially with the expansion of electronic litigation procedures and the adoption of notary services electronically, which contributes to reducing time and effort and speeding up the resolution of cases. He added that the approval of this project alongside the draft law amended for the Notary Law for the year 2025 will establish a new stage of digital judicial services, enhancing the ministry's capacities in providing more flexible and quality services.

 

He mentioned that these amendments will transition us from paper-based reality to the digital reality we must achieve in our ministries, institutions, and departments, especially in light of the development in infrastructure, governance, cybersecurity, and artificial intelligence.

 

Talhouni also noted that the amendment came to remove the exceptions included in the previous text, allowing all procedures to be performed electronically to the extent that it does not conflict with the specific provisions of related legislation. He also indicated that some transactions are currently being carried out electronically in ministries, institutions, and courts, such as remote trials and electronic signatures. Since last September, 65,000 digital documents have been signed in the Amman Magistrate's Court and its four departments, which led to speedier procedures and reduced congestion.

 

And the Justice Minister affirmed that this amendment does not stipulate compulsion, but it allows the use of electronic means in transactions, emphasizing that the texts must be associated with other related legislations.
