Head of Jordanian Contractors loses control over a general meeting and dozens of institutions demand the dissolution of the admi

Khaberni - The head of Jordanian contractors, Engineer Fouad Al-Dweiri, lost control yesterday, Saturday, during the general assembly meeting of the union amidst massive chaos and verbal altercations that almost escalated to Khaberni physical confrontations.
Al-Dweiri tried, as shown by video clips which Khaberni apologizes for not publishing, to pass new laws by the vote of the general assembly attendees, but this failed, and many contractors left their seats to the stage of the administrative body amidst an unprecedented state of chaos.
In an unusual development, the session of the general assembly of the Contractors Union was adjourned, and Khaberni committees were formed to discuss 3 laws including the health insurance system law.
Al-Dweiri stated that the three proposed laws will be referred to specialized committees for extensive discussion and study. These include: amendments to the union law, the investment fund law, and the health insurance law, aiming to agree on the final version of the legislation that serves the interest of the Jordanian contractor Khaberni.
However, matters escalated after the general assembly meeting ended, and dozens of contractors issued a Khaberni statement in strong terms, demanding the dissolution of the administrative body chaired by Al-Dweiri, and below is the text of the statement issued by them:

Based on the provisions of the Jordanian Construction Contractors Union Law and the internal regulations issued accordingly, and starting from the principle of sovereignty of the general assembly as the owner of mandate and decision-making, the members of the general assembly would like to state their position regarding what took place in the unusual general assembly meeting (second session) convened to discuss the projects of amending the union law, investment system, and health insurance system, as follows:

Firstly: The members of the general assembly believe that the proceedings of the meeting did not achieve the legal purpose for which it was convened, due to improper session management that did not ensure an organized and equal discussion enabling the general assembly to exercise its right to discuss the laws and regulations presented and make the right decision about them.

Secondly: Despite the legal and procedural observations that accompanied the invitation and session convening, the general assembly exercised its legal powers, and expressed in a clear and explicit manner its disagreement with the proposed laws and regulations presented for discussion by the head.

Thirdly: The general assembly expresses its rejection of the statement subsequently issued by the union, both in title and content, as it did not reflect the actual decision made during the meeting. The decision issued by the general assembly involved dismissing all the proposed laws and regulations, without any decision taken to adjourn the session for later discussions or approving the formation of committees or any substitute procedures.

Fourthly: The general assembly clarifies that the proposal related to forming committees, which was presented during the meeting by the deputy head, was explicitly rejected, a fact recorded in the minutes of the session and supported by available documentation.

Fifthly: The general assembly points out that the departure of the head, deputy head, and some members of the union council from the session, in the presence of the representative of the Minister of Public Works and Housing, occurred without an issuance of decision or authorization from the general assembly, which is considered a violation of procedural norms followed in managing general assembly meetings and a decrease in respect for the general assembly as the owner of mandate and highest union authority.

Sixthly: In accordance with the provisions of the union law, the general assembly continued its meeting, and the session was completed and voting was conducted, where the general assembly, with the majority of attendees' votes, rejected the proposed laws and regulations.

Therefore, the general assembly confirms the following:
    1.    That the general assembly is the exclusive authority in adopting or rejecting the proposed laws and regulations presented to it.
    2.    That the decision issued by it is to reject all the proposed laws and regulations without forming committees or adopting any alternative procedural paths.

Based on the foregoing, the general assembly addresses the Minister of Public Works and Housing to bear his responsibilities and verify the proceedings of the meeting within the legal and regulatory frameworks in force.
