Khaberni - Legal researcher Raed Tabishat revealed the most significant anticipated legal amendments to the Sharia Enforcement Law, which are expected to be announced soon.
Tabishat clarified that imprisonment will remain in effect in cases of failure to pay alimony or Sharia debts, with a general trend towards minimizing its use as much as possible.
Tabishat stated that the amendments aim to give the sentenced party—often the husband—a chance to work and earn in order to meet his financial obligations, ensuring that the rights of the wife and children are not harmed, while keeping him under judicial supervision.
He explained that the amendment project includes allowing the use of electronic monitoring (electronic bracelets) in cases where the Sharia judge deems it in the interest, which alleviates the sentenced individuals on one hand, and ensures their commitment to payment on the other hand.
He indicated that the amendments consider the self-employed, by providing an opportunity to rectify their financial situation without affecting the rights of the creditors of Sharia debts, noting that electronic monitoring procedures will include strict conditions in case of evasion or delay in payment.
Tabishat confirmed that there will be no changes to custody within the package of anticipated changes.
