Cabinet Approves Settlement of Penalties for Scholarship Recipients Under Specific Conditions

Khaberni - The Cabinet decided in its session held on Sunday, headed by Prime Minister Jafar Hassan, to approve the exemption of scholars funded by official universities from the due penalties; this is to provide an opportunity for those who have obligations to the official universities to rectify their financial situations and to alleviate their burden.

The decision stipulated a full exemption from the penalties due if the scholar pays the original claim amount (the total actual cost of the scholarship in one payment) to the Ministry of Finance / Directorate of Public Funds or directly to the concerned university.

It also stipulated an exemption for the scholar from 50% of the penalties due if they choose to installment the original claim (the total actual cost of the scholarship) and the remaining penalties over a period of 12 months, provided that financial guarantees are submitted, with the settlement to be completed.

The decision also included an exemption for the scholar who has paid the full actual cost of the scholarship and part of the penalties from the remaining penalties due, and also considering any amounts previously paid by scholars to the universities or to the Ministry of Finance / Directorate of Public Funds as part of the actual expenses, if the amount paid is less than these expenses. However, if the paid amounts exceed the actual expenses of the scholarship, the scholar is exempted from the rest of the penalties and no refunds are made.

Regarding the cases of scholars that have resulted in final judgments in favor of the universities or are still being considered by the competent courts, they are dealt with by exempting the claims in which final judgments have been issued from the value of the penalties, provided that the actual expenses of the scholarship plus the fees, expenses, attorney's fees, and legal interest due on the original scholarship amount are paid in one payment.

As for the cases still being considered by the competent courts and for which no final judgments have been issued, the exemption from penalties applies, provided that the actual expenses of the scholarship and any due fees and expenses for the case are paid in one payment, and that the competent court is addressed to drop the case according to proper procedures.
