New System for the Guarantee Fund for Employees in the Ministry of Education with a Mandatory Subscription of 6

Khaberni - The Legislation and Opinion Bureau has published the Social Security Fund system for employees at the Ministry of Education, which mandates a 6% subscription of the total monthly salary for all ministry employees and a one-time non-refundable membership fee of 20 dinars.

According to the draft system observed by "Al-Mamlaka", the system offers financial compensations including 4,000 dinars in cases of death or permanent total disability, and distributes additional compensations governed by the years of service and the reason for termination.

The system aims to secure a sustainable financial protection umbrella for employees in the educational sector and to unify services within a more modern and organized legal framework.

The system establishes an administratively and financially independent fund at the Ministry of Education, chaired by the Minister of Education and involving senior ministry officials and heads of education committees, to ensure transparent and specialized management. The General Assembly is responsible for approving general policies, the budget, final accounts, and appointing an auditor, while the Board of Directors meets at least monthly to oversee the implementation of decisions and organize disbursement and investment operations.

Mandatory subscription and clear payment mechanisms

Subscription to the fund is mandatory for all employees, with a 6% monthly deduction from the salary. The subscriber is obligated to prepay the subscriptions in cases of unpaid leave, secondment, or lending.

Membership automatically stops upon non-payment, with subscriptions refunded to the subscriber. Also, members of the previous system are considered de facto subscribers with their subscription years counted.

Graduated compensations

The employee or their heirs are entitled to 4,000 dinars in cases of total disability or death, proportionally adjusted for cases of partial disability. The subscriber also receives 1,000 dinars upon the spouse's death, and subscriptions are returned to the heirs in case of the subscriber's death.

Upon service termination; all subscriptions are returned to those who served less than 10 years or whose service was terminated by dismissal, job loss, or redundancy.

The system grants those who resign after completing 10 years full access to their subscriptions, plus 100 dinars for each year after the tenth year.

Those who complete 15 years or more are entitled to a salary of 15 months for the first 15 years of service, and 150 dinars for each subsequent year upon civil retirement, old age, early retirement, death, or illness, provided they continue in the public sector and pay monthly subscriptions.

The system guarantees that the compensation will not be less than the total subscriptions and allows continued subscription upon the employee's transfer without a request, within a specified deadline.

Financial advances according to the fund's solvency

The fund offers a one-time advance of up to 6,000 dinars without interest deducted from the benefits, and an emergency advance of up to 1,500 dinars repaid from the salary, according to annually issued instructions that consider the financial solvency of the fund.

The fund's resources include subscriptions, membership fees, financial returns, donations, and grants, with borrowing permitted when necessary without imposing any responsibility on the general treasury. The fund uses banks to deposit its money and invests it within a conservative policy to ensure sustainability.

The system nullifies the 1998 system and considers the new fund as its legal successor, with the continued application of previous instructions until they are amended or replaced according to the new system, ensuring a smooth transition and protecting the rights of employees.
