Khaberni - In the context of Saudi Arabia's efforts to develop the work environment and guarantee the rights of all parties, the Ministry of Human Resources and Social Development, in cooperation with the Ministry of Justice, has approved the authenticated employment contract as an executory document, a new measure that represents a qualitative leap in organizing the contractual relationship between the employee and the employer, aiming to achieve justice, transparency, and reducing disputes in the labor market.
What is the authenticated employment contract as an executory document?
Under the new resolution, the authenticated employment contract is considered a legal document eligible for judicial enforcement, which means that the salary clause in the contract has now become an executory document allowing any party of the contractual relationship (the employee or the employer) to file a direct execution request in case of non-compliance with salary payments or financial obligations, without the need for additional documents or lengthy judicial procedures.
Data verification is automatically performed through the technical integration of the "Khaberni", "Mudad", and "Najiz" platforms, to ensure accuracy of information and speedy processing of requests.
Goals of the new decision
The adoption of the employment contract as an executory document aims to achieve a set of strategic goals, most notably:
Enhancing the protection of rights for both employees and employers.
Establishing principles of justice, commitment, and fairness in contractual relationships.
Accelerating the processing of financial complaints related to wages.
Improving the work environment and increasing compliance levels within establishments.
Reducing labor disputes through preventive digital solutions that ensure rights proactively.
Mechanism for applying the executory document
The new mechanism allows the worker to directly file an execution request in case of delayed or insufficient payment of due wages, following these guidelines:
If the employee does not receive his salary within 30 days from the due date, he can submit an execution request via the Najiz platform.
In case a part of the salary is received only after 90 days, he also has the right to submit an execution request.
Each authenticated employment contract is granted an execution number issued by the Ministry of Justice, granting it direct legal force.
The employer is allowed to object within only 5 days from the notification date through the same platform.

The second phase (March 6, 2026): Includes fixed-term contracts that are renewed after this date.
The third phase (August 6, 2026): Includes indefinite-term contracts, making all types of contracts in the Kingdom covered by the executory document.

To benefit from the advantages of this decision, both the employer and the employee must follow the next steps:
Document the contract via the Khaberni platform affiliated with the Ministry of Human Resources.
Ensure that all data is entered accurately, especially the salary clause.
Obtain an execution number from the Documentation Center at the Ministry of Justice after validation.
Maintain online contract status via the Mudad platform to monitor wage payments and update information.
Impact of the decision on the work environment and investment
It is expected that this decision will enhance trust and stability in the Saudi labor market, as it provides a quick digital legal tool for preserving rights without the need for disputes in court.
The new measure also supports Saudi Arabia's efforts to improve the investment environment and its attractiveness to foreign talents and professionals, through a work environment based on transparency and digital justice.
The adoption of the authenticated employment contract as an executory document represents a pivotal step in the digital and organizational transformation of the Saudi labor market. It not only accelerates access to rights but also enhances the principle of preventive justice and ensures the immediate and fair execution of commitments between parties, within a comprehensive digital system that connects government agencies and serves both citizens and residents equally.
