Khaberni - Within just 48 hours, Federal Judge Karen J. Emergut issued two consecutive rulings against the administration of U.S. President Donald Trump, halting his plan to deploy National Guard troops in Oregon, specifically in the city of Portland.
Emergut, who was appointed by Trump during his first presidential term, has become the talk of the media and political circles after she stopped a presidential order on Sunday evening to deploy troops from the National Guard in California to be moved to Portland, in a move that represented an escalation in the confrontation between the judiciary and the White House.
It was the same judge who had issued a ruling the day before (Saturday) preventing the American president from federalizing the National Guard and deploying it in Oregon, considering that the federal administration’s justifications “threatened to blur the line between civil and military authority”.
Who is Karen Emergut? Emergut is one of the known judges in the American judicial system and has held the position of judge in the federal district court in Oregon since her appointment in 2019. Before that, she served in the local judicial system and previously held positions in the public prosecutor's office. Although Trump nominated her for this position, her recent rulings revealed her judicial independence and confirmed that she does not hesitate to stand against any constitutional violation, even if it comes from the party that appointed her.
Why does she reject Trump's military decisions? Emergut believes that the use of federal power to deploy military forces within cities must adhere to precise constitutional standards, and can only be justified by a clear and urgent necessity. In her latest ruling, she wrote: “The government's justification for the deployment plan threatens to erase the line between civil and military authority, and this poses a direct risk to the balance of powers in the country.”
The White House responds. President Donald Trump quickly responded to the judge's decisions, publicly attacking her through social media platforms, describing her decisions as “biased,” and affirming that his administration will challenge the rulings and continue attempts to control the security situation in cities he considers to be “in chaos.” Why Portland? And why now? In recent years, the city of Portland has been a center for political demonstrations and clashes between protesters and the police, especially during Trump's first term of office. As the upcoming presidential elections approach, Trump seeks to affirm his stance as a “law and order man,” yet his moves meet strong legal resistance.
