Emirati girl pays 11000 Dirhams to buy gold from a scammer on Instagram

Khaberni - The Abu Dhabi Court for Family, Civil, and Administrative cases ruled to compel a scammer to return 11,000 Dirhams to a girl, which he got after convincing her through an advertisement on "Instagram" that he owned a gold shop. She transferred the amount to purchase one of the items shown in the advertisement, but he kept the money for himself.

In detail, a girl filed a lawsuit against a man she accused of fraud, demanding he pay her 11,000 Dirhams in addition to covering the fees and expenses. She indicated that the defendant deceived her through a fraudulent advertisement on "Instagram" claiming he owned a gold shop and displayed several pictures of gold items. She liked one and transferred the demanded amount, but he took it and she did not receive the gold, resulting in his criminal conviction and a fine of 20,000 Dirhams.

From its side, the court stated in its ruling that according to the established civil transaction laws, "No one is entitled to take someone else's property without a legitimate reason, and if taken, he must return it," noting that the criminal verdict issued in the case conclusively differentiated the act that formed the common basis between the civil and criminal cases, its legal description, and its attribution to the actor.

The court noted that the defendant did not attend to present anything that would clear his responsibility for the demanded amount, which was determined by the criminal verdict. Consequently, the lawsuit was based on a valid foundation of facts and law, and the court ruled by presence, obliging the defendant to pay the plaintiff 11,000 Dirhams as well as covering the lawsuit expenses and fees.
